 **Terms and Conditions for Concrete Pumping Services**

1. **Scope of Services:**

a. We provide concrete pumping services as per the specifications and requirements agreed upon with the client.

b. Our services include the operation of concrete pumping equipment and related machinery by trained professionals.

2. **Booking and Scheduling:**

a. Clients must schedule concrete pumping services in advance.

b. We require accurate information regarding job site location, concrete requirements, and any specific instructions.

c. Changes to scheduled appointments must be communicated at least 24 hours in advance.

3. **Site Preparation:**

a. Clients are responsible for ensuring the job site is accessible, safe, and ready for concrete pumping operations.

b. Any obstacles or hazards that may impede the pumping process must be addressed before our arrival.

4. **Concrete Quality and Delivery:**

a. Clients are responsible for ordering and providing concrete of suitable quality and quantity for the job.

b. We are not liable for any issues arising from the quality or delivery of concrete supplied by third-party vendors.

5. **Equipment and Personnel:**

a. Our team will arrive with all necessary equipment and personnel to complete the job efficiently and safely.

b. Clients must provide appropriate access to the job site for our vehicles and equipment.

6. **Safety and Liability:**

a. We prioritise safety at all times and adhere to industry standards and regulations.

b. Clients are responsible for ensuring a safe working environment for our personnel and equipment.

c. We are not liable for any damages or injuries resulting from factors beyond our control, including but not limited to, site conditions, third-party actions, or natural disasters.

7. **Payment Terms:**

a. Payment terms will be agreed upon before the commencement of services.

b. Clients are responsible for payment of all services rendered, including any additional costs incurred due to unforeseen circumstances or changes to the original scope of work.

c. Late payments may be subject to penalties or interest charges as specified in the agreement.

8. **Cancellation and Refunds:**

a. Cancellations made less than 24 hours before the scheduled appointment may be subject to cancellation fees.

b. Refunds will be issued at our discretion in accordance with the terms of the agreement.

9. **Intellectual Property:**

a. Any designs, plans, or intellectual property provided by us remain our exclusive property unless otherwise agreed in writing.

10. **Dispute Resolution:**

a. Any disputes arising from this agreement will be resolved through negotiation and mediation in good faith.

b. If mediation fails, disputes will be resolved through arbitration in accordance with the laws of New Zealand.

11. **Amendments and Modifications:**

a. These terms and conditions may be amended or modified only in writing and signed by both parties.

12. **Governing Law:**

a. This agreement shall be governed by and construed in accordance with the laws of New Zealand.

By engaging our services, clients acknowledge that they have read, understood, and agreed to abide by these terms and conditions. These terms and conditions constitute the entire agreement between the client and Pump Link and supersede all prior agreements and understandings, whether written or oral.
